These Terms and Conditions are a binding agreement between you and Five Senses Creator Program. By applying for or participating in the program, you agree to follow the rules, eligibility requirements, commission terms, content usage rules, payout conditions, and conduct standards stated below.
Five Senses may update these Terms from time to time. Continued participation in the Creator Program after any updates means that you accept the revised Terms.
1. Definitions
For the purpose of these Terms and Conditions, the following definitions shall apply:
- Creator / Affiliate: An individual or entity approved by Five Senses to promote Five Senses through referral codes, links, social media content, or other approved marketing materials.
- Referral Code: A unique promo code assigned to the creator for tracking bookings and providing guest discounts.
- Materialized Transaction: A booking where the guest has successfully completed the stay and checked out without cancellation, refund, chargeback, fraud, or dispute.
- Commission: The reward payable to the creator for valid materialized bookings generated through their referral code.
- Adjustment Event: Any event that affects the booking value or commission amount, including cancellations, refunds, chargebacks, fraud, booking amendments, or payment disputes.
- Sense Wallet: The creator account balance where approved commissions and eligible rewards are recorded before withdrawal.
2. Eligibility & Registration
- Creators must provide accurate personal information, contact details, social media profile links, banking details, and any other required information during registration.
- Creators must have at least 1,000 real followers on Instagram, TikTok, Facebook, Thread, Lemon8, XiaoHongShu (XHS), or other approved platforms.
- Creators with fewer than 50,000 followers are expected to maintain a minimum engagement rate of 8.5%.
- Five Senses reserves the right to reject, approve, suspend, or terminate any application at its sole discretion.
- Fake followers, bot engagement, misleading profile information, or duplicated applications may result in rejection or termination.
- Creators are responsible for ensuring that their bank account details are accurate. Five Senses shall not be responsible for failed payouts caused by incorrect information provided by the creator.
3. Creator Responsibilities
- Creators must promote Five Senses honestly, professionally, and in a way that protects the brand image.
- Creators must not make false claims, misleading promises, fake discounts, or inaccurate statements about Five Senses properties, prices, promotions, or services.
- Creators must ensure that all content posted is original, legal, and does not infringe the rights of any third party.
- Creators must not use spam, fake traffic, bots, paid click farms, or any black-hat marketing methods to generate bookings.
- Creators must not represent themselves as employees, agents, official spokespersons, or legal representatives of Five Senses.
4. Commission & Guest Benefits
- Influencer Reward: Approved creators may earn 8% commission on eligible room rate revenue from materialized bookings.
- Guest Incentive: Guests may receive 10% discount on eligible room rates when using the creator’s referral code.
- Commission is calculated based on room revenue only.
- Commission does not apply to taxes, service charges, food and beverage, add-on services, cleaning fees, extra guest charges, refundable deposits, or any non-room charges.
- If a booking is modified, cancelled, refunded, partially refunded, disputed, or charged back, the commission may be adjusted or removed.
5. Validation Period & Payout
- All creator earnings are subject to a 60-day validation period after the guest completes the stay.
- The validation period is used to verify that the booking is genuine, completed, and not affected by cancellation, refund, chargeback, fraud, or other adjustment events.
- The minimum payout amount is RM 500.
- If the creator’s approved balance is below RM 500, the amount will remain in the creator’s wallet and roll over to the next payout cycle.
- Five Senses may withhold, delay, or adjust payouts if suspicious activity, payment issues, or booking disputes are detected.
- Creators with zero materialized bookings for 6 consecutive months may have their account deactivated.
6. Sense Wallet Interest
- A 6% annual interest rate may be applied to eligible funds held in the Sense Wallet, accrued monthly.
- Interest is only applicable to eligible balances that remain in the wallet according to Five Senses’ wallet rules.
- If a creator withdraws before the required 1-year retention period, all accrued interest may be forfeited.
- Five Senses reserves the right to revise, suspend, or discontinue wallet interest benefits at any time.
7. Content Usage Rights
- By creating or submitting content related to Five Senses, the creator grants Five Senses Asia a perpetual, worldwide, royalty-free license to use, repost, edit, publish, translate, reproduce, and distribute the content for marketing and promotional purposes.
- This includes photos, videos, captions, reviews, testimonials, social media posts, reels, stories, and other creative materials related to Five Senses.
- Five Senses may use creator content on websites, social media platforms, paid advertisements, email campaigns, printed materials, and other marketing channels.
- Creators confirm that they own or have permission to use all content submitted or published.
8. Marketing Restrictions
- Creators must not bid on “Five Senses”, “Five Senses Experience Suite”, or similar brand keywords in search engine marketing campaigns.
- Creators must not create websites, pages, ads, or profiles that imitate the official Five Senses website or mislead users into thinking they are official Five Senses channels.
- Creators must not use unauthorized discount claims, fake urgency, misleading prices, or fake availability information.
- Creators must not promote the referral code on coupon abuse websites, spam channels, or any platform that may harm the Five Senses brand.
9. Fraud, Abuse & Adjustment Events
- Five Senses reserves the right to investigate suspicious traffic, unusual booking patterns, duplicate bookings, fake accounts, self-referrals, or any activity that appears fraudulent.
- Bookings generated through fraud, abuse, fake accounts, unauthorized channels, or misleading promotions will not be eligible for commission.
- If commission has already been credited for an invalid booking, Five Senses may reverse or deduct the amount from the creator’s wallet or future payout.
- Creators involved in fraud or serious misconduct may face immediate termination and forfeiture of unpaid earnings.
10. Account Suspension & Termination
- Creators may request to leave the program by giving 30 days’ written notice.
- Five Senses may suspend or terminate a creator account immediately if the creator breaches these Terms, damages the brand reputation, commits fraud, or provides false information.
- Upon termination, unpaid commissions may be reviewed and only valid materialized transactions will remain eligible for payout.
- Five Senses reserves the right to deactivate inactive accounts with no valid bookings for 6 consecutive months.
11. Limitation of Liability
- Five Senses shall not be liable for indirect, incidental, special, or consequential losses arising from participation in the Creator Program.
- Five Senses does not guarantee any minimum earnings, bookings, traffic, exposure, or conversion results.
- Creators participate in the program at their own cost and responsibility.
12. Governing Law & Disputes
- Any dispute should first be resolved through good-faith discussion between the creator and Five Senses.
- If the dispute cannot be resolved informally, it may be referred to regional arbitration or other dispute resolution methods determined by Five Senses.
- These Terms are governed by the applicable laws and regulations relevant to Five Senses operations.
